Castaway
TERMS OF SERVICE

Terms of Service

The agreement between you, anglers, and the guides and outfitters who host trips on Castaway.

Last updated: October 23, 2026

1. The marketplace

Castaway Inc. (“Castaway,” “we,” “us”) operates a marketplace that connects anglers with independently owned and operated guides and outfitters. We are not the provider of any fishing trip. Every trip is offered, operated, and fulfilled by the guide or outfitter who lists it (“Host”). We facilitate booking, payments, and communication only.

Castaway is a technology intermediary. We are not a charter operator, a guide service, a fishing outfitter, or an owner or operator of any vessel, boat, or equipment. We do not provide, operate, or control any trip, vessel, or gear. Accordingly, Castaway is not liable for the licensing, insurance, permits, safety, or local compliance of any Host or any trip.

2. Hosts: licences, registration & insurance

If you list trips as a Host, you are solely responsible for holding and keeping current every licence, permit, vessel registration, operator certification, and insurance policy required where you operate, including any requirement that applies to carrying paying guests. You confirm that every trip you list complies with the laws that apply to it.

Each Host expressly warrants and represents that they hold every licence, permit, registration, operator certification, and insurance policy required for the specific body of water on which they operate, at the local, state or provincial, and federal level, and that this information is complete, current, and accurate.

Castaway does not check whether a Host meets these requirements, except where a Host chooses to upload a document for a badge. A badge only means Castaway reviewed that one document when it was uploaded. It is not a guarantee that the Host is fully licensed, registered, or insured, or that a trip is safe or lawful. Castaway may remove listings or suspend Hosts who do not meet these requirements.

3. Independent Hosts

Nothing in these terms creates an employment, partnership, joint venture, agency, or other relationship between Castaway and any Host. Each Host is an independent business owner who offers and operates their own trips, sets their own prices and terms, and is solely responsible for their own operations, taxes, payroll, insurance, and compliance. A Host is not an employee, agent, or representative of Castaway, and Castaway has no right to direct or control the manner in which a Host operates a trip.

4. Accounts

You must be 18 or older and provide accurate information to create an account. You are responsible for safeguarding your credentials and for all activity under your account.

5. Booking, deposits & balance

When you book a trip you pay a deposit online. Your booking is marked Pending confirmation until the Host confirms it. If the Host declines or the trip cannot run, your deposit is refunded in full.

The remaining balance is charged in full when the Host confirms your booking (the Airbnb model). You agree to authorization to charge the balance at confirmation.

6. Cancellations

Cancellation terms are set per trip and shown at checkout. In brief: you may cancel before a Host confirms for a full refund; after confirmation, Host and weather cancellation rules in the Refund & Cancellation policy apply. See the Refund & Cancellation Policy for the full breakdown.

7. Conduct & safety

You agree to follow all applicable laws and your Host’s safety instructions. Fishing is inherently risky; you book at your own risk and should be aware of, and accept, the hazards involved.

8. Reviews & prohibited content

Reviews reflect the honest experience of verified guests. You may not post fraudulent, defamatory, or unlawful content. We may remove content or suspend accounts that violate these terms.

9. Indemnification

To the maximum extent permitted by law, each Host agrees to indemnify, defend, and hold harmless Castaway and its directors, officers, employees, and affiliates from and against any claims, damages, liabilities, costs, or expenses, including reasonable legal fees, arising out of: (a) the Host’s trip, vessels, equipment, or operations; (b) the Host’s failure to comply with any law, licence, permit, or insurance requirement; (c) any injury, damage, or loss to the Host or any guest; or (d) the Host’s breach of these terms. If a Host operates illegally or suffers an uninsured accident, the Host is responsible and Castaway is held harmless from any resulting legal liability or guest claims.

10. Disclaimers & limitation of liability

Castaway is provided “as is.” To the maximum extent permitted by law, Castaway is not liable for any indirect, incidental, or consequential damages arising from a trip or your use of the platform.

11. Changes

We may update these terms from time to time. Material changes are announced on this page; continued use after an update constitutes acceptance.
