SMS COMMUNICATIONS & OPT-IN POLICY

SMS Communications & Opt-In Policy

How we collect your consent to receive text messages, what we send, and how you can stop at any time.

Last updated: September 10, 2026

1. Program Description & Sender Identification

Castaway Inc. (“Castaway,” “we,” “us”) operates the Castaway marketplace connecting anglers with guides and outfitters. When you opt in to our SMS notification service, text messages will be sent by Castaway Inc. on behalf of Castaway and the host guide or outfitter associated with your trip booking. For any questions regarding our text messaging program, contact us at support@castaway.guide.

2. How We Obtain Your Express Consent

We obtain express written consent prior to sending text messages. Consent is collected when you intentionally toggle or check the Text Message Opt-In field within your account settings or booking flow.

  • Active Opt-In: Checkboxes are never pre-selected.
  • Separation of Consent: Opting in to SMS is completely voluntary and separate from completing a booking, account creation, or agreeing to our general Terms of Service.
  • Consent Audit Trail: We record your opt-in timestamp, IP address, and phone number to verify consent upon request.
  • No Impact on Service: You are not required to consent to SMS communications as a condition of purchasing or using Castaway's marketplace.

3. Types of Messages & Frequency

Castaway sends time-sensitive, transactional, and service-related messages to facilitate your booked trips, including:

  • Booking confirmations and receipts
  • Critical pre-trip weather or logistics reminders (e.g., 24-hour reminder)
  • Essential guide-to-angler trip notifications
  • Post-trip follow-up and review requests

Message Frequency: Message frequency varies based on your trip activity. Typically, you will receive up to 5 messages per booked trip.

4. Message & Data Rates

Standard message and data rates may apply to any text messages sent or received, depending on your mobile carrier and service plan. Castaway does not charge a fee for receiving text messages, but you are responsible for all charges levied by your mobile service provider.

5. How to Opt Out (STOP) or Get Assistance (HELP)

You may opt out of SMS communications at any time through any of the following methods:

  • Opt-Out (STOP): Reply STOP to any text message received from Castaway. You will receive a single confirmation text confirming your unsubscribe request. No further text messages will be sent unless you opt back in.
  • Help (HELP): Reply HELP to any message for customer support details, or email support@castaway.guide.
  • Account Settings: You can toggle your SMS preferences on or off anytime under your Castaway account settings.

6. Mobile Data Privacy & Third-Party Sharing Restrictions

We respect your privacy. Mobile information collected through the SMS opt-in program will be handled in accordance with our Privacy Policy.

  • No Selling or Sharing: Your mobile phone number, opt-in data, and consent will not be sold, rented, or shared with third parties or affiliates for marketing or promotional purposes.
  • Service Providers: Data may only be shared with underlying SMS platform providers strictly to facilitate message delivery on our behalf.

7. Regulatory Compliance (CASL & TCPA)

  • CASL Compliance: As a Canadian entity based in Alberta, our commercial electronic messages comply with the Canadian Anti-Spam Legislation (CASL). Every message clearly identifies Castaway as the sender and provides a functional opt-out mechanism.
  • Carrier Disclaimer: Wireless carriers (e.g., Rogers, Bell, Telus, AT&T, Verizon, T-Mobile) are not liable for delayed or undelivered messages.

8. Related Terms & Policies

SMS communications are subject to our Terms of Service and Privacy Policy.
